In the state of NC – Homeowners Insurance Question?
If a neighbors tree falls on our house, who is responsible for repairs – us, or the neighbor? The cause of the tree falling would be from high winds.
Does the insurance company matter? We have USAA.
We are surrounded by those tall, skinny pine trees that eastern NC is notorious for. I have a few on our property, but they’re away from the house. Most of them are on the neighbors property, and some ARE rotted/dying. Would verbal contact with him be sufficient? Or would you suggest that I write him a letter?? This may sound silly, but every time the wind blows hard, those trees sway and lose dead branches. The soil is very sandy, and the trees are not rooted deep. Not to mention, this particular row of trees is on a slope.

I’m going to say that unless your neighbor knew that their tree was either dead, dying or posed some risk to your property and did nothing about it, then they are not responsible for high winds damaging your house in this manner.
Your insurance would be the one to cover this type of damage.
Except in ONE instance, it is going to be you. Your homeowners policy will cover the damage the neighbor’s tree did when it fell on your house.
The ONLY time they can be held responsible, is if the tree was rotted, AND the neighbor knew it, and didn’t do anything. And it’s pretty darned hard to PROVE that they know it’s rotted.
The insurance company doesn’t matter. USAA is a great company, they shouldn’t give you any grief over it, however, you ARE going to have a deductible.
that would fall on your policy to cover if it was caused by winds. your policy should cover the cost of removing the tree and cleanup and repairs to the home.
