aparently when I redid my loan with my mortgage company last year, due to the type of loan or whatever, home insurance was no longer part of the monthly premium as I thought it was. now I have found that the home insurance lapsed as of 12/05/05. i need to find a insurance company that will work with me on getting insured again.

Galactus asked: We have a policy with Travelers that was $1047.00 a year. I shopped around for new insurance and now have a new policy for $538.00 for the same coverage but the house value has been adjusted to what it is actually worth now (it seems that they were still working off of the value during 2006 when we got the policy). The new policy will become effective as soon as the old one ends on July 1, 2009. However I’ve paid into my escrow all year for what the anticipated bill of 1000 was going to be for homeowners, now there is going to be extra money in the escrow account, as well as all the money that is in there for my taxes (enough is in there to fulfull that obligation as well). My question is will Countrywide (now BOA) refund me the overpayment into escrow? I wouldn’t mind if they put it towards the principle of the home but I would rather put it as a payment against my credit card (also through BOA) instead. And also, how long does it take for the Mortgage company to readjust my payment as my insurance is now lower (in the past when my premium had gone up they adjusted the mortgage payment to put more into escrow), but now it will not need as much. AGain, I wouldn’t care if more was put towards principle but I would like to get my CC paid off sooner and it has a higher interest rate than my mortgage.

I’ve had my condo for 5 yrs and my current loan is 3 years old. 6 months ago a new mortgage company purchased my loan and has forced their homeowners insurance on me. I obtained the proper documentation from my condo association showing I have in fact been insured for the past 5 years. I sent it to my mortgage co., but they are still adding an extra $300/month for their insurance. They’ve hung up on me, are rude and I can’t exactly drive to them and settle this in person.
There is no question that this is not legal…I cannot be forced to have 2 policies. When we spoke they said even if it was resolved they would not give me a refund, they’d put it into the principle balance. Because I shouldn’t have been billed this in the first place I want a check sent to ME. I believe I need to get a lawyer involved to help me get my money. What type of lawyer could help with this? (ps- I live in VA)
YES it is coming out of my pocket. Every month.

Jereme D asked: We have a leak in our roof. Insurance company sent an appraiser out to take a look. A week later they sent us a check for $12,000. A contractor I regularly use quoted me a price of $2,000 to do the repairs. I didn’t show him the quote sheet from the insurance company because I didn’t want him to know how much we received for the repairs, but I’m pretty confident he knows exactly what needs to be done to repair it correctly.
In the letter that has the estimate, it says I need to submit a receipt for the repair work done, but then I got the check shortly after the estimate arrived, so it seems as if they wouldn’t need a receipt now since they’ve already cut the check.
My question is, can my insurance company come back later and ask for extra money back in what they sent minus the actual repair cost? Or can I spend the extra money however I want?
The check is written to myself and the mortgage company.

Allstate just raised our homeowners insurance by $50/month and that is more than we can afford right now. Is there a law that require we have homeowners insurance? Does our mortgage company require it?
